New registration requirements for SMS

 Dear valued RingCentral customer,

In 2021, mobile carriers imposed new restrictions on business SMS traffic sent from text-enabled phone numbers, known as “10DLC,” in line with industry requirements set out in the CTIA Messaging Principles and Best Practices.

The mobile carriers have extended these restrictions to all business SMS, including conversational texting. All customers using SMS must now self-register with The Campaign Registry (TCR) or their SMS traffic will be blocked by the mobile carriers.

To simplify this process, RingCentral will be adding the ability to self-register inside of the admin portal. We expect this feature to be available February 10, 2023 at which time we highly recommend you register. Please note carriers and TCR impose registration and other fees. After March 31, 2023, SMS will be automatically disabled for all existing numbers that have not been registered. If you have already registered via the manual PDF form process, your registration will automatically be added to the admin portal for you to manage moving forward. 1. Make sure you have a check box on your form to OPT IN to text messages 
2. Make sure your privacy policy (also make sure you have one on your website, on every page) talks about "SMS Consent and phone number will never be shared for any reason."

Privacy policy requirement
Your organization must have a privacy policy linked on all website pages in a visible location, presented on a single page. This policy should clearly explain how personal information is collected, used, and shared. Importantly, it must state that SMS consent and phone numbers collected for SMS purposes will not be shared with third parties. as required by TCR.

Opt-in requirement
When collecting phone numbers on your website, include an opt-in checkbox that is not pre-selected and is optional. The statement should say: "By checking this box, I agree to receive SMS messages about [Message Type] from [company name] at the phone number provided above. The SMS frequency may vary. Data rates may apply. Text HELP to 1-123-456-7899 for assistance. Reply STOP to opt out of receiving SMS messages" The checkbox must be separate from other consent types, and the opt-in language should specify the types of SMS messages the recipient may receive, such as promotional or informational.

Terms of service for SMS
The Terms of Service related to SMS communication must either be included in the privacy policy or be a stand-alone document. The document must include the following:

  1. Consent for SMS Communication:
    • A statement confirming that information obtained as part of the SMS consent process will not be shared with third parties.
  2. Types of SMS Communications:
    • A clear description of the types of SMS communications a customer might receive. This must include examples like:
      • Customers and Guests: Updates regarding orders, deliveries, or other relevant information.
      • Job Applicants: Information about application status, onboarding materials, or other employment-related updates.
  3. Standard Messaging Disclosures:
    • Include standard message disclosures:
      "Message and data rates may apply.  Messaging frequency may vary
    •  You can opt-out at any time by texting 'STOP.' For assistance, text 'HELP' or visit our [Privacy Policy URL] and [Terms of Service URL]."
